Terms of Service

1. Agreement
By purchasing a package or engaging VanPelt Digital ("we," "us," "VanPelt") you agree to these Terms. If you do not agree, do not use our services.
2. Services
We design, build, host, and maintain websites for local businesses. The specific deliverables for your project are described in the package you purchased and your intake form. Out-of-scope work is billed separately and quoted in writing before we begin.
3. Payment
Initial payment is due before work begins. Monthly care plans renew automatically until cancelled. Failed payments may pause your project or take your site offline until resolved.
4. Refunds
You may request a refund within 7 days of your initial deposit if no work has begun. Once design or development has started, deposits are non-refundable. Monthly plans can be cancelled at any time and will not renew the following month.
5. Client responsibilities
You agree to provide content, photos, and feedback in a timely manner. Projects delayed by more than 60 days due to client inaction may be paused and require a restart fee to resume.
6. Ownership
On final payment, you own the design, content, and copy of your website. We retain the right to showcase the project in our portfolio. Third-party tools, plugins, and licensed assets remain subject to their original licenses.
7. Hosting & uptime
We target 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party providers, DNS, or events outside our control.
8. Liability
Our total liability is limited to the amount paid for the service in the preceding 3 months. We are not liable for indirect, incidental, or consequential damages including lost profits or data.
9. Termination
Either party may terminate with 30 days' notice. On termination, outstanding balances become immediately due and hosting may be discontinued.
10. Changes
We may update these Terms from time to time. Material changes will be communicated by email.
